Online purchasing terms
Article 1 – Purpose and scope
1.1. These general conditions of sale determine the rights and obligations of the parties when selling products via the “Les Doubles R” website, accessible at the address www.lesdoublesr.be . These general conditions exclusively govern the sales of the products presented on the site.
1.2. The general conditions are concluded between, on the one hand, the company/individual "LES DOUBLES R" (TVA BE BE 0674 546 908 ), located at Grand'route de Mons 87 7334 Hautrage - Belgium , herein referred to as the "Seller" and, on the other hand, the person wishing to browse the site and place an order, hereinafter referred to as the “customer”. The customer and the Seller are jointly referred to as the “parties”. The parties agree that their interactions will be governed solely by these terms and conditions, excluding any other terms.
1.3. Each order of a product on the site requires consultation and unreserved acceptance of the general conditions by the customer. This without requiring a manual signature from the customer. In accordance with the regulations in force in Belgium on electronic signatures, the seller can perceive the customer's order via the means offered (see article 2.3) as equivalent to a handwritten signature.
1.4. Any customer placing an order on the site must have full legal capacity.
1.5. The seller has the right to change the general conditions and will notify users via the site.
Article 2 – Respect for private life
LES DOUBLES R is firmly committed to honoring the trust you place in it by ensuring the protection of your privacy in accordance with the laws in force. As a customer, you have the right to access, modify and delete personal information about you. Article 3 – Online purchasing procedure
3.1. Product or service pricing
The prices of the products or services offered on the site are expressed in euros and include VAT. They include delivery costs. Any price change subsequent to purchase will not be applicable; the Products will be invoiced according to the price in place when the order is confirmed.
3.2. Shipping fees
When ordering, the Customer is informed that shipping costs are included in the purchase cost of the Products. However, in the event of exercising the right of withdrawal or following a legal guarantee, as detailed in articles 6 and 7 of these General Conditions, these shipping costs initially included will be deducted from the amount reimbursed to the Customer.
3.3. Placing an order
To place an order, the customer must exclusively use the order form available on the site. It will be necessary to provide essential information for the finalization of the transaction. Responsibility for any inconvenience arising from the provision of incorrect information lies with the customer. By validating his order on the site, the customer confirms his full acceptance of these general conditions and undertakes to pay the total amount due.
3.4. Proof of transaction
The seller's archives will be considered as proof of exchanges and transactions carried out between the parties.
3.5. Refusal of order
LES DOUBLES R reserves the right to refuse or cancel any order or delivery in the event of disagreement with the customer, non-payment or partial payment of a previous order, or in the event of refusal of payment authorization by a banking institution. In these situations, the liability of LES DOUBLES R cannot be called into question.
3.6. Cancellation of order by the Customer
The customer is authorized to cancel his order as long as it has not been shipped. The payment request will then be canceled immediately, and if the payment had already been made, it will be refunded in full. After receipt of the products, cancellation of the order is no longer possible, however, the right of withdrawal remains applicable (see article 6).
Article 4 – Payment Terms
4.1 . Payment methods
Purchases made on the site must be paid exclusively via the payment methods offered by Shopify Payment.
4.2. Validation and Ownership
The transaction is considered concluded when payment validation is confirmed. The products ordered remain the entire property of the seller until full payment has been received.
4.3. Liability in the event of an incident on the Internet
Faced with complications or damage inherent to the use of the Internet, such as a computer virus, the seller cannot be held liable.
Article 5 – Delivery
5.1. Territory and Deadlines
The seller ensures delivery of the products throughout Belgium and France. After confirmation of the order, delivery is made to the address indicated by the customer within the following working days. Deliveries take place between 8 a.m. and 6 p.m. and can be received by anyone present at the specified address. In the event of unavailability, a notice will indicate the procedure to follow. If the order is not collected within 2 weeks, it will be returned to the Seller and additional costs may be charged to the customer.
5.2. Reception confirmation
Delivery is considered completed as soon as the customer or a third party at the specified address receives the product. From this point on, all risk relating to the product passes to the customer. Proof of this receipt is provided by the delivery service.
5.3. Inspection at Receiving
The customer is invited to inspect the products upon receipt. If irregularities are detected or if the package has obviously been opened or damaged, the customer may refuse it. Any complaint must be sent to the seller within three working days following delivery.
Article 6 – Withdrawal and Return of Products Procedure
6.1. Withdrawal Notification
The Customer has the right to withdraw from his purchase without reason, within fifteen (15) calendar days following receipt of the goods. Following his decision to withdraw, the Customer must return the products to the Seller within 10 days. If these deadlines are not respected, the right of withdrawal will be considered void.
6.2. Return Conditions
Contact customer service so that they can tell you where to return the item and how to do so.
6.3. Refund conditions
Upon receipt and after verification of the returned products, the Seller undertakes to reimburse the customer, except for delivery costs, within thirty (30) calendar days.
6.4. Reimbursement Process
Customers who paid by credit card will have the amount of the returned items credited to the same card. In other cases, reimbursement will be made using the means selected by the customer.
6.5. Integrity of Returned Products
The products must be returned in perfect condition, in their original packaging, accompanied by all their accessories and documents. Any damaged, incomplete or soiled product will not be exchanged or refunded.
Article 7 – Legal Guarantee
7.1. Consumer Rights
The legal guarantee covers any lack of conformity manifesting within two years following delivery. If a defect is observed within six months after delivery, it is presumed to have existed from origin. After this period, the Seller may challenge this presumption.
7.2. Management of Warranty Returns
Unlike the right of withdrawal, the costs of returning a defective item will be borne by the seller. In the event of an exchange, the seller will also cover the delivery costs.
Article 8 – Dispute Management
8.1. Jurisdiction
Any dispute relating to these general conditions is subject to Belgian law. The courts of Brussels will have jurisdiction in the event of a dispute, unless the Parties reach an amicable agreement.
8.2. Preservation of Evidence
All communications between the customer and the seller will be kept and may serve as proof in the event of a dispute.
8.3. Consistency of Clauses
Even if one or more stipulations of these general conditions are held to be invalid or declared as such, the other clauses retain their full force and scope.
